A 36-year-old Floyd County man has been arrested as part of an investigation into a back window being shot out of a taxicab early New Year’s Day outside a Seymour bar.

Christopher D. Bierly of Floyds Knobs faces a preliminary Level 5 felony charge of criminal recklessness with a deadly weapon in connection with the incident in the area of On The Rox at 214 S. Broadway St., police report.

No one was injured in the incident reported at about 3:15 a.m. Saturday, according to a news release from Lt. C.J. Foster with Seymour Police Department.

Bierly denied knowing anything about the incident, but according to witnesses, he fired a gun two times — once into the air and once into the taxicab, Foster said.

Officers sent to investigate the report were directed to the west side of the business where witnesses were pointing at a possible suspect, later identified as Bierly, Foster said.

Bierly first attempted to hide from police but officers were able to arrest him and also found a firearm while searching him, police said.

Investigators were called to process the scene and conduct, Foster said. The recovered spent spent shell casings and a bullet from the headline from inside the taxicab.

Bierly, who also faces a Class A misdemeanor charge of possession of a handgun without license, was booked into the Jackson County Jail in Brownstown at 6:44 a.m. Saturday. He was being held without bond Sunday pending his initial court appearance.

Foster said the investigation and more arrests are possible.

A Level 5 felony is punishable by one to six years in prison upon conviction. The advisory sentence is five years.
