A Seymour man was arrested Thursday on child molesting and battery charges after a warrant was issued for his arrest in connection with an incident that happened last month in the city, police report.
Mark Alan Hurley, 62, faces a preliminary Level 4 felony charge of child molesting-fondling or touching a child under 14 and a Level 6 charge of battery on a person less than 14.
Hurley’s arrest stems from an investigation that started Dec. 13, when Seymour Police Department was notified of an incident involving a 10-year-old girl and Hurley. That incident occurred at an apartment complex in the 1300 block of West Second Street in Seymour, Detective Sgt. Chris Franklin said.
After the incident occurred at Hurley’s apartment, the victim immediately reported it to her family. The family then contacted SPD after the child told them what happened, Franklin said.
Franklin said it was a singular incident based on interviews conducted with Hurley and the victim.
Franklin turned the case over to the Jackson County Prosecutor’s office after completing his investigation, and Jackson Circuit Judge Richard W. Poynter issued the arrest warrant Thursday.
Franklin arrested Hurley at his residence around 3:30 p.m. and took him to the Jackson County Jail in Brownstown where he is being held without bond pending his initial hearing with Poynter.
A Level 4 felony is punishable between two and 12 years with an advisory sentence of six years, upon conviction. A Level 6 felony is punishable by six months to two and a half years if convicted with an advisory sentence of one year.
